Terms of Service

These Terms of Service ("Terms") govern your use of the Gulo mobile app and related services (together, "Gulo," "we," "us," or "our"). By creating an account or using Gulo, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Gulo.

Eligibility

You must be at least 13 years old to use Gulo. If you are between 13 and 17 years old, you may only use Gulo with the knowledge and permission of a parent or guardian, who agrees to these Terms on your behalf and is responsible for your use of Gulo. Gulo applies additional safety restrictions to users under 18, including disabling one-time current-location sharing in chat.

License to Use Gulo

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Gulo app on a device you own or control, solely for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of the app, except where applicable law permits despite this restriction. We may suspend or terminate this license at any time as described in "Termination" below.

Your Account

Activities and Meetups

Gulo helps users plan and discover runs, walks, and hikes, but Gulo does not supervise activities or verify every route, location, host, participant, or meetup detail. Use judgment before meeting others, and follow local laws, trail rules, weather advisories, and safety practices.

User Content and Intellectual Property

"User Content" means anything you submit to Gulo, including your profile information, photos (profile photos, group photos, activity banners), activity details, routes, bios, group descriptions, messages, and reports. You retain ownership of your User Content. By submitting User Content, you grant Gulo a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute it solely as needed to operate, secure, and improve Gulo (for example, showing your activity banner to other participants, or showing your profile photo to your followers).

You represent and warrant that you own, or have all necessary rights and permissions to use and share, every photo and piece of content you upload to Gulo — including profile photos, group photos, and activity banners — and that your User Content does not infringe or violate any third party's copyright, trademark, privacy, publicity, or other rights. Do not upload a photo you found online, a screenshot of someone else's content, or any image you do not have the right to use. Gulo, the Gulo logo, and related marks are owned by Gulo and may not be used without our prior written permission.

Copyright Complaints (DMCA)

Gulo respects intellectual property rights and expects users to do the same. If you believe content on Gulo infringes your copyright, send a written notice to runwithgulo@gmail.com with the subject line "DMCA Notice" that includes:

Upon receiving a valid notice, we will remove or disable access to the identified material and notify the user who posted it. That user may submit a counter-notice with substantially the same information (identifying the removed material and stating, under penalty of perjury, a good-faith belief that it was removed by mistake or misidentification), after which we may restore the material unless the original complaining party files a court action within the time required by law. We may terminate the accounts of users who are found to be repeat infringers.

Community Rules

You must follow our Community Guidelines. Do not harass, threaten, spam, deceive, exploit, or endanger other users. Do not post illegal, hateful, sexually explicit, violent, or unsafe content, and do not post content you do not have the rights to post.

Gulo has zero tolerance for child sexual abuse, child sexual exploitation, grooming, trafficking, sexualized content involving minors, or any attempt to use Gulo to harm, contact, exploit, or endanger a minor. We may remove content, terminate accounts, preserve relevant records, and report suspected child exploitation or abuse to appropriate authorities when required or appropriate.

Reports, Blocks, and Enforcement

Gulo may review reports, restrict features, remove content, suspend accounts, or terminate accounts when we believe it is necessary to protect users, enforce these Terms, or comply with law. Blocking a user may limit profile, chat, and activity visibility between users.

Third-Party Services

Gulo may integrate with third-party services such as Supabase, Resend, Google, Apple, and device operating system services. Your use of third-party services may also be governed by their terms and policies.

Third-party services and content are provided "as is" and "as available." To the fullest extent permitted by law, Gulo disclaims on behalf of its third-party service providers all express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Third-party service providers are not liable through Gulo for consequential, special, punitive, indirect, or incidental damages.

No Emergency or Safety Service

Gulo is not an emergency service, route safety service, medical service, coaching service, or background tracking service. If you are in danger, contact local emergency services.

Disclaimers

Gulo is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that Gulo will be uninterrupted, error-free, accurate, secure, or available at all times, or that any activity, host, or participant meets any particular standard of safety or reliability.

Limitation of Liability

To the fullest extent permitted by law, Gulo and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or personal injury, arising from or related to your use of Gulo, user meetups, routes, activities, or third-party services, even if advised of the possibility of such damages. To the extent any liability is not excluded, our total liability for any claim arising out of or relating to Gulo will not exceed the greater of $100 or the amount you paid us, if any, in the 12 months before the claim arose. Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Gulo and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your violation of these Terms, or your use of Gulo, including any in-person activity you attend or host through Gulo.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise. Before filing a claim, you agree to try to resolve the dispute informally by contacting runwithgulo@gmail.com. Either party may bring an individual claim in small claims court instead of arbitration if it qualifies. Otherwise, you and Gulo agree that any dispute arising out of or relating to these Terms or Gulo will be resolved by binding, individual arbitration seated in Utah, and that you and Gulo each waive the right to a jury trial and to participate in a class action or class arbitration. [This arbitration and class-action-waiver clause should be reviewed with a licensed Utah attorney before publishing, since enforceability against users under 18 who may accept these Terms can require additional safeguards.]

Termination

You may stop using Gulo and delete your account at any time (see "Account Deletion" below). We may suspend or terminate your access to Gulo at any time, with or without notice, if we believe you have violated these Terms, the Community Guidelines, or applicable law, or to protect the safety of the community. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

Account Deletion

You can permanently delete your own Gulo account at any time, directly in the app, without contacting support: open Settings > Delete account and confirm. See our Privacy Policy and account deletion page for details on what is deleted and what limited records are retained for safety and legal reasons.

Apple App Store Additional Terms

If you downloaded Gulo from the Apple App Store, you also acknowledge the following, which apply between you and Apple in addition to these Terms:

Changes to These Terms

We may update these Terms as Gulo changes. If changes are significant, we will provide notice in a reasonable way, such as in the app or on this website. If you continue using Gulo after updates take effect, you accept the updated Terms.

General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy and Community Guidelines, are the entire agreement between you and Gulo regarding your use of Gulo. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
